Data Controller and Contact Details<\/h2>\n<ol>\n<li>The controller of personal data is <strong>Wailz sp. z o.o.<\/strong> with its registered office at ul. Odrow\u0105\u017c\u00f3w 23\/11, 41-506 Chorz\u00f3w, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000776278, NIP 6272761590, REGON 382833066, BDO 000736842, with a share capital of PLN 5,000.00, hereinafter referred to as the \u201cController\u201d.<\/li>\n<li>The Controller can be contacted:\n<ul>\n<li>by email: <a href=\"mailto:info@kaukazbazar.pl\">info@kaukazbazar.pl<\/a>;<\/li>\n<li>by telephone: <a href=\"tel:+48739902539\">+48 739 902 539<\/a>;<\/li>\n<li>in writing at the Controller\u2019s registered office.<\/li>\n<\/ul>\n<\/li>\n<li>The address of the warehouse used for the physical handling of orders, complaints and returns is: ul. Obroki 130, hala 2, brama 7, 15i, 40-833 Katowice.<\/li>\n<\/ol>\n<h2>2. Scope of Personal Data Processed<\/h2>\n<p>Depending on how the Website is used, the Controller may process in particular:<\/p>\n<ul>\n<li>identification data, such as first and last name, company name, NIP and details of the person representing the company;<\/li>\n<li>contact details, such as email address, telephone number, billing address and delivery address;<\/li>\n<li>data relating to the user account, orders, payments, the selected delivery method and collection point, complaints, returns and communications with the Controller;<\/li>\n<li>data voluntarily provided in a message, form, review or other submission;<\/li>\n<li>technical data relating to the use of the Website, such as the IP address, online identifiers, device and browser type, operating system, date and time of visits, pages visited, referral source and information stored in cookies or similar technologies.<\/li>\n<\/ul>\n<p>The Controller does not require the provision of special categories of personal data referred to in Article 9 of the GDPR. Such data should not be included in forms or correspondence unless this is necessary to deal with a specific matter.<\/p>\n<h2>3. Purposes and Legal Bases of Processing<\/h2>\n<p>Personal data are processed for the following purposes and on the following legal bases:<\/p>\n<ol>\n<li><strong>Operation of the basket, placement and fulfilment of an order and performance of the sales contract<\/strong> \u2013 Article 6(1)(b) of the GDPR. This includes order confirmation, accepting and processing payment, preparing the shipment, delivery, contact concerning fulfilment and refunds.<\/li>\n<li><strong>Creation and administration of a customer account<\/strong> \u2013 Article 6(1)(b) of the GDPR. Creating an account is voluntary and is not necessary to place an order if the Website allows purchases without registration.<\/li>\n<li><strong>Issuing and retaining accounting documents and complying with tax, accounting and other obligations arising from law<\/strong> \u2013 Article 6(1)(c) of the GDPR.<\/li>\n<li><strong>Handling complaints, withdrawals from the contract, returns, enquiries concerning the conformity of goods with the contract and other customer rights<\/strong> \u2013 Article 6(1)(b) and (c) of the GDPR and, after the matter has been concluded, also Article 6(1)(f) of the GDPR for the purpose of documenting its course and protecting against claims.<\/li>\n<li><strong>Responding to messages, enquiries and requests for a quotation<\/strong> \u2013 Article 6(1)(b) of the GDPR where the contact is intended to lead to the conclusion of a contract, or Article 6(1)(f) of the GDPR where the basis is the Controller\u2019s legitimate interest in conducting communications and providing responses.<\/li>\n<li><strong>Enabling the submission, publication and verification of reviews<\/strong> \u2013 Article 6(1)(f) of the GDPR. The Controller\u2019s legitimate interest is to present reliable reviews, prevent abuse and indicate whether a review was submitted by a person who made a purchase.<\/li>\n<li><strong>Establishing, pursuing or defending claims, preventing fraud and abuse, and ensuring Website security<\/strong> \u2013 Article 6(1)(f) of the GDPR. The Controller\u2019s legitimate interest is to protect its rights, customers, data and technical infrastructure.<\/li>\n<li><strong>Compiling basic statistics, maintaining the Website and improving its operation<\/strong> \u2013 Article 6(1)(f) of the GDPR in respect of technical data and technologies that are necessary or do not require consent. Analytics using optional cookies or similar technologies are carried out only after consent has been obtained \u2013 Article 6(1)(a) of the GDPR.<\/li>\n<li><strong>Newsletters, commercial communications and direct electronic marketing<\/strong> \u2013 only where such a function is made available and the user voluntarily gives the relevant consent: Article 6(1)(a) of the GDPR and the applicable provisions of the Polish Electronic Communications Law. Consent may be withdrawn at any time without affecting the lawfulness of processing carried out before its withdrawal.<\/li>\n<li><strong>Marketing and personalisation using optional cookies or similar technologies<\/strong> \u2013 Article 6(1)(a) of the GDPR, only after the user\u2019s consent has been obtained.<\/li>\n<\/ol>\n<h2>4. Voluntary Provision of Data<\/h2>\n<ol>\n<li>Providing the data marked as required in the order form is necessary to conclude and perform the contract. Failure to provide this data will make it impossible to place or properly fulfil the order.<\/li>\n<li>Providing data required by tax or accounting legislation is mandatory where that data is necessary to issue the appropriate sales document.<\/li>\n<li>Providing data to create an account, send an enquiry, submit a review or receive marketing communications is voluntary; however, without the data necessary for a particular function, it may not be possible to provide that function.<\/li>\n<li>Optional fields may be left blank. The Controller asks users not to provide data that is not necessary for the selected purpose.<\/li>\n<\/ol>\n<h2>5. Recipients of Personal Data<\/h2>\n<p>Data may be disclosed only to the extent necessary to achieve a specified purpose:<\/p>\n<ul>\n<li>providers of hosting, server, email, Website maintenance and security, and IT support services;<\/li>\n<li>payment service providers, banks and other entities involved in handling the selected payment method;<\/li>\n<li>carriers, logistics operators and operators of collection points or parcel lockers;<\/li>\n<li>providers of accounting, tax, legal, audit, debt recovery or insurance services;<\/li>\n<li>providers of tools for customer service, communications, reviews, statistics or marketing \u2013 in the case of optional tools, only to the extent covered by the consent given;<\/li>\n<li>authorised public authorities, courts or other entities where disclosure is required by law.<\/li>\n<\/ul>\n<p>Entities acting on the Controller\u2019s behalf process data under appropriate agreements and only in accordance with its documented instructions, unless the law provides otherwise. A payment service provider, bank, carrier or other service provider may also act as an independent controller to the extent determined by its own legal obligations and terms of service.<\/p>\n<h2>6. Transfers of Data Outside the European Economic Area<\/h2>\n<ol>\n<li>The Controller gives preference to providers that process data within the European Economic Area. However, certain technologies or service providers may result in data being transferred to a country outside the EEA.<\/li>\n<li>Where such a transfer takes place, it is carried out only on the basis of a mechanism permitted by the GDPR, in particular a European Commission adequacy decision, standard contractual clauses or another appropriate legal basis, with additional safeguards where required.<\/li>\n<li>Information about providers using cookies and similar technologies, including possible transfers, is available in the current <a href=\"https:\/\/kaukazbazar.pl\/en\/polityka-plikow-cookies-eu\/\">Cookie Policy (EU)<\/a>. Information about the safeguards applied may also be obtained by contacting the Controller.<\/li>\n<\/ol>\n<h2>7. Retention Periods<\/h2>\n<p>Data are not retained for longer than necessary. The period depends on the purpose and legal basis of processing:<\/p>\n<ul>\n<li>order and contract data \u2013 for the time necessary to perform the contract and thereafter until the end of the period for retaining documentation required by tax and accounting legislation and until the expiry of the applicable limitation periods for claims;<\/li>\n<li>customer account data \u2013 until the account is deleted or the account service ends and thereafter, to the extent necessary, until the expiry of limitation periods for claims or the fulfilment of legal obligations;<\/li>\n<li>data relating to complaints, returns or withdrawals \u2013 for the duration of handling and resolving the matter and thereafter until the expiry of the applicable limitation periods for claims and periods required by law;<\/li>\n<li>correspondence data \u2013 for the time needed to respond and conclude the matter and thereafter for the period necessary to demonstrate its course or protect against claims;<\/li>\n<li>data processed on the basis of consent \u2013 until consent is withdrawn, the purpose is achieved or the data are found to be no longer current; information necessary to demonstrate the giving or withdrawal of consent may be retained until the expiry of the limitation period for claims relating to the processing;<\/li>\n<li>reviews \u2013 for the period of their publication or until an effective objection is made, where there are no overriding legitimate grounds for further processing, taking into account the time necessary to protect against abuse and claims;<\/li>\n<li>technical logs and security data \u2013 for the period resulting from system configuration and needs relating to security, diagnostics and the prevention of abuse;<\/li>\n<li>data stored in cookies \u2013 for the period specified for the relevant cookie in the current Cookie Policy (EU), or until it is deleted earlier or consent is withdrawn.<\/li>\n<\/ul>\n<h2>8. Rights of Data Subjects<\/h2>\n<p>Subject to the conditions set out in the GDPR, a data subject may have:<\/p>\n<ul>\n<li>the right of access to personal data and to receive a copy;<\/li>\n<li>the right to rectify inaccurate data and complete incomplete data;<\/li>\n<li>the right to erasure of personal data;<\/li>\n<li>the right to restriction of processing;<\/li>\n<li>the right to data portability where data are processed by automated means on the basis of consent or a contract;<\/li>\n<li>the right to object, on grounds relating to the person\u2019s particular situation, to processing based on Article 6(1)(f) of the GDPR;<\/li>\n<li>the right to object at any time to the processing of personal data for direct marketing purposes;<\/li>\n<li>the right to withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.<\/li>\n<\/ul>\n<p>A request to exercise these rights may be sent to <a href=\"mailto:info@kaukazbazar.pl\">info@kaukazbazar.pl<\/a>. To protect personal data, the Controller may request information enabling it to confirm the identity of the person making the request. The scope of each right and the circumstances in which it may be exercised are governed by the GDPR.<\/p>\n<p>A person who believes that their personal data are being processed unlawfully has the right to lodge a complaint with the <strong>President of the Personal Data Protection Office<\/strong>. The supervisory authority\u2019s current contact details are available at <a href=\"https:\/\/uodo.gov.pl\/\" target=\"_blank\" rel=\"noopener\">https:\/\/uodo.gov.pl\/<\/a>.<\/p>\n<h2>9. Automated Decision-making and Profiling<\/h2>\n<ol>\n<li>The Controller does not make decisions concerning users based solely on automated processing that would produce legal effects or similarly significantly affect them.<\/li>\n<li>If a user consents to optional marketing or analytics technologies, data may be used to create audience groups, measure effectiveness or tailor content. Such activities do not automatically produce legal effects or similarly significant consequences for the user.<\/li>\n<\/ol>\n<h2>10. Cookies and Similar Technologies<\/h2>\n<ol>\n<li>The Website uses cookies and similar technologies that are necessary for its operation, security, session management, remembering the contents of the basket, enabling login and storing privacy settings.<\/li>\n<li>Cookies that are not necessary, in particular analytics or marketing cookies, are activated only after the user\u2019s consent has been obtained. Refusal to consent to such technologies does not prevent a purchase, although some additional functions may operate in a limited manner.<\/li>\n<li>Consent can be managed using the \u201cManage consent\u201d panel available on the Website. Blocking necessary cookies may, however, prevent the basket, login or other essential store functions from operating correctly.<\/li>\n<\/ol>\n<h2>11. Data Security<\/h2>\n<p>The Controller applies technical and organisational measures appropriate to the risk in order to protect data against loss, unauthorised access, disclosure, alteration or destruction. Access to data is granted only to persons and entities that require it to perform their duties or provide services to the Controller.<\/p>\n<h2>12. Changes to the Privacy Policy<\/h2>\n<ol>\n<li>The Policy may be updated if the law, the operation of the Website, the range of features offered, or the providers and technologies used change.<\/li>\n<li>The current version is published on the Website together with its effective date.
